Labor and Employment Litigation
Clients have relied on our attorneys to successfully address the complex issues that arise daily in labor and employment disputes. Our attorneys are experienced in state, federal, and appellate courts in handling Title VII claims, age, race, sex and gender discrimination claims, and hostile work environment claims arising under both state and federal law. In addition, our attorneys have experience in labor disputes, labor and employment arbitrations, and Fair Labor Standards Act (“FLSA”) and state wage and hour claims.
Employment
Our attorneys have first-hand experience in addressing claims from the outset of an Equal Opportunity Employment Complaint (“EEOC”) federal administrative action, as well as handling complaints under state laws and regulations. We have represented clients starting with pre-claim demands through the administrative process, and we have handled those claims that did not have an early resolution through the litigation process. We have represented clients in claims involving Americans with Disabilities Act (“ADA”), age discrimination, race discrimination, pregnancy discrimination, and gender discrimination, all with results favorable to our clients.
Unemployment
Our attorneys are also experienced in unemployment compensation claims. We have first-hand knowledge of initial claim requests, claim denials, and the administrative appellate process. Unemployment claims can be a procedural maze and our attorneys’ experience can help you navigate this confusing process.
FLSA and Wage and Hour Claims
A growing sector in employment-related litigation involves the FLSA. Recent verdicts around the country challenge traditional holdings as to the class of employee and applicability of the FLSA. Our attorneys are experienced in handling the challenging issues raised under the FLSA and have successfully represented clients in litigation arising under the FLSA.
In addition to claims under federal laws, our attorneys have represented a variety of clients in claims arising under state wage and hour laws. A sample of the cases our attorneys have handled include claims for past due wages, disputed vacation benefits, calculation of overtime wages, compensation based on commissions and contractual wages, and claims for statutory penalties and attorney’s fees related to wage disputes.
Non-Compete Agreements
Our attorneys have been engaged by several clients to address and litigate non-compete agreements, including litigating injunctions regarding the enforcement of non-compete agreements. In today’s ever changing business world, we have represented clients in disputes regarding non-compete limitations, non-compete enforcement, professional non-compete agreements, negotiation of non-compete agreements and the validity of non-compete agreements. Our attorneys are experienced in the drafting and application of non-compete agreements, as well as litigating the validity of non-compete agreements.
